Terms of Service

1. Acceptance of Terms

By accessing or using Markot (“Service”), signing in via AutoMono Core SSO, or embedding our widgets, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of an entity, you represent and warrant that you possess the authority to bind said entity.

2. Subscription Tiers, Billing & Quotas

Markot provides tiered subscription plans: Free Starter, Growth Pro (€49/mo), and Scale Enterprise (€199/mo).

  • Quotas: Each tier provides designated allocations for AI Campaign Generations, Active Omni-Channel Subscribers, and Webhook Dispatches. Usage exceeding subscription caps may require tier upgrading or incur metered add-ons.
  • Invoicing & VAT: Payments are processed via AutoMono Tax-api delegation. Valid EU VAT IDs are reverse-charged in accordance with European Directive 2006/112/EC. Downloadable VAT invoices are accessible under Billing settings.
  • Cancellation: Subscriptions can be cancelled at any time with effect at the end of the current billing cycle.

3. Acceptable Use & Anti-Spam Policy

You agree not to use the Service to publish, generate, or broadcast:

  • Unsolicited commercial communications (“spam”) or purchased contact lists lacking verified opt-in consent under GDPR / ePrivacy Directive.
  • Fraudulent, defamatory, infringing, or malicious content.
  • Automated actions designed to bypass platform rate limits, scrape unauthorized competitor private endpoints, or disrupt third-party social APIs.

Violations of our Anti-Spam policy will result in immediate suspension of broadcast capabilities and token revocation.

4. Intellectual Property & Content Ownership

You retain all proprietary rights, title, and ownership in and to the content, media, and marketing plans generated through Markot for your workspace. Markot claims no intellectual property rights over your proprietary campaign creative assets.

5. Service Level Agreement (SLA) & Liability

We strive to maintain a 99.9% uptime target for webhooks and broadcast dispatches. Markot shall not be liable for delivery failures caused by upstream carrier restrictions (e.g., WhatsApp Meta Graph API outages, Telegram network degradation, or recipient mailbox bounces).

6. Governing Law & Jurisdiction

These terms are governed by and construed in accordance with the laws of Spain and the European Union. Any dispute arising out of or related to these terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
